Thank you for choosing Pictoniq.

These Terms & Conditions govern the photography services provided by Pictoniq. By booking our services and paying the required booking fee, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

These terms apply to all photography services provided by Pictoniq throughout Australia.


About Pictoniq

Pictoniq is an Australian photography business providing professional photography services including:

  • Wedding Photography
  • Event Photography
  • Family Photography
  • Maternity Photography
  • Corporate Photography
  • Commercial Photography

Our primary service areas include Perth, Melbourne, Sydney, and surrounding regions.


Booking Confirmation

A booking is considered confirmed only when:

  • Availability has been confirmed by Pictoniq; and
  • The required 25% non-refundable booking fee has been received.

Until both requirements are met, Pictoniq reserves the right to accept other bookings for the requested date.


Booking Fee

A 25% booking fee is required to secure your booking.

The booking fee:

  • Reserves your date and time.
  • Covers administration and planning.
  • Is non-refundable except where required under Australian Consumer Law.

Final Payment

Unless otherwise agreed in writing:

  • The remaining balance must be paid before image delivery.
  • Commercial projects may follow different payment terms as agreed in writing.

Pictoniq reserves the right to withhold delivery of photographs until full payment has been received.


Pricing

All quotations are valid for the period specified in the quotation.

Prices may change without notice for future bookings.

Any additional services requested after booking may incur additional charges.


Cancellations

If you choose to cancel your booking:

  • The 25% booking fee is non-refundable.
  • Cancellation more than 30 days before the scheduled photography session will not incur any additional fees beyond the booking fee.
  • Cancellation within 14–30 days of the scheduled session may require payment of 50% of the remaining balance.
  • Cancellation within 14 days of the scheduled session may require payment of the full remaining balance, unless otherwise agreed by Pictoniq.

These terms reflect the loss of a reserved date that may not be rebooked at short notice.

Nothing in these Terms limits your rights under Australian Consumer Law.


Rescheduling

We understand that plans can change.

Clients may request one complimentary reschedule provided:

  • Reasonable notice is given (preferably at least 7 days before the booking); and
  • The new date is available.

Weather-related rescheduling for outdoor sessions will be accommodated where reasonably possible.

Additional rescheduling requests may incur an administration fee.


Late Arrival

Clients are responsible for arriving on time.

If a client arrives late:

  • Session time may be reduced accordingly.
  • Pictoniq is not required to extend the session.
  • No refund or discount will be provided for lost session time due to client lateness.

Photographer Illness or Emergency

If Pictoniq is unable to attend due to illness, injury, emergency, or circumstances beyond reasonable control:

  • We will make reasonable efforts to arrange a suitable replacement photographer.
  • If a replacement cannot be arranged, our liability is limited to refunding any payments received for the affected booking.

Photography Coverage

Pictoniq will make every reasonable effort to capture important moments throughout your session or event.

However, photography is an artistic service and specific images, poses, or moments cannot be guaranteed.

Photography results may be affected by factors outside our control, including:

  • Weather
  • Venue restrictions
  • Lighting conditions
  • Guest interference
  • Ceremony or venue rules
  • Delays to the event schedule
  • Cooperation of participants

Guest Interference

Pictoniq is not responsible for missed photographs where coverage is affected by:

  • Guests using cameras or mobile phones
  • Individuals obstructing the photographer
  • Venue restrictions
  • Celebrants or event coordinators
  • Security requirements
  • Other third parties

Artistic Style

By booking Pictoniq, you acknowledge that you have reviewed our portfolio and are familiar with our photographic and editing style.

Photography is an artistic service.

Editing decisions, colour grading, cropping, retouching, composition, and overall presentation are made at Pictoniq’s professional discretion.

Delivered photographs will reflect our signature editing style.


Editing Requests

Standard editing is included in your package.

Requests for changes to Pictoniq’s editing style, colour grading, artistic approach, or overall look are not included.

Minor corrections may be considered at Pictoniq’s discretion.

Extensive re-editing or additional editing requests may attract additional charges or be declined.

RAW files are not supplied.


Image Selection

Pictoniq will select the best photographs from your session.

Images that are blurred, duplicated, poorly exposed, or otherwise unsuitable may be excluded at our discretion.

The decision regarding final image selection rests solely with Pictoniq.


Image Delivery

Estimated delivery times are:

  • Weddings: 15 days to 1 month
  • Events: 5–14 days
  • Family Sessions: 10–15 days
  • Commercial Photography: 10–15 days

These are estimates and may vary during busy periods.


Online Galleries

Photographs may be delivered through an online gallery.

Unless otherwise agreed:

  • Galleries remain available for approximately 30 days.
  • Password protection is available upon request.

Clients are responsible for downloading and safely backing up all photographs before gallery expiry.


Image Storage

Original RAW files are generally retained for approximately 30 days after final delivery.

Edited images and galleries may also be removed after this period.

Pictoniq is not responsible for maintaining long-term archives of client photographs.


Copyright

All photographs remain the intellectual property and copyright of Pictoniq unless otherwise agreed in writing.

Clients receive a non-exclusive licence to use delivered images for personal purposes.

Commercial clients receive usage rights as agreed for their project.

Copyright is not transferred unless specifically stated in writing.


Portfolio & Marketing

Pictoniq will only use client photographs on our website, portfolio, blog, or social media where permission has been provided by the client.

If permission is not granted, your images will remain private unless required by law.


Commercial Use

Photographs may not be sold, licensed, entered into competitions, or commercially reproduced by clients unless commercial usage rights have been granted.


Client Cooperation

Clients are responsible for:

  • Obtaining venue permissions where required.
  • Informing family members or participants of photography arrangements.
  • Ensuring children are supervised during sessions.
  • Advising Pictoniq of any important people or moments that should receive particular attention.

Limitation of Liability

While every reasonable effort is made to provide exceptional photography services, Pictoniq shall not be liable for delays, interruptions, missed photographs, or failure to perform caused by circumstances beyond our reasonable control.

These circumstances may include, but are not limited to:

  • Extreme weather
  • Equipment malfunction despite reasonable precautions
  • Venue restrictions
  • Illness or emergencies
  • Traffic incidents
  • Government restrictions
  • Power outages
  • Internet failures
  • Actions of guests or third parties

To the extent permitted by law, Pictoniq’s total liability for any claim arising from photography services shall not exceed the total amount paid by the client for the affected booking.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law.


Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict, or modify any consumer guarantees or rights that cannot legally be excluded under the Australian Consumer Law.


Privacy

Personal information is handled in accordance with our Privacy Policy, available on our website.


Governing Law

These Terms & Conditions are governed by the laws of Western Australia.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Western Australia.
