Copyright & Image Usage Policy

At Pictoniq, we believe every photograph tells a story. This policy explains who owns the copyright of our photographs, how images may be used, and what rights both Pictoniq and our clients have.

By booking our photography services, you agree to this Copyright & Image Usage Policy.

Copyright Ownership

All photographs created by Pictoniq remain the intellectual property and copyright of Pictoniq unless otherwise agreed in writing.

Booking a photography session or receiving digital images does not transfer copyright ownership.

Personal Use Licence

For personal photography services such as:

Weddings
Family Sessions
Maternity Photography
Engagement Sessions
Private Events

clients receive a non-exclusive, perpetual licence to use their delivered photographs for personal purposes.

This includes:

Sharing on social media
Printing photographs
Creating albums
Displaying photographs in your home
Sharing with family and friends

This licence does not transfer copyright ownership.

Commercial Photography Licence

For commercial and corporate photography, Pictoniq grants clients a licence to use delivered images for the agreed business purposes.

Examples include:

Business websites
Company social media
Marketing materials
Advertising campaigns
Brochures
Annual reports
Promotional content

Any usage outside the agreed scope may require additional written permission.

What Clients May Not Do

Unless written permission has been provided by Pictoniq, clients may not:

Sell the photographs.
Transfer image rights to another business or person.
Claim copyright ownership.
Submit photographs into commercial stock libraries.
Use photographs in a manner that suggests Pictoniq has endorsed a product, service, or organisation.
Remove or alter any copyright information where it has been included.

Editing of Delivered Images

Every photograph delivered by Pictoniq is professionally edited to reflect our signature style.

By booking Pictoniq, clients acknowledge that they have viewed our portfolio and understand our editing approach before engaging our services.

Because photography is an artistic service:

Editing decisions are made at Pictoniq’s professional discretion.
Colour grading, cropping, exposure, composition, and retouching reflect our creative style.
Extensive requests to change our editing style are not included in standard packages.

Minor corrections may be considered where reasonably requested.

Requests for extensive re-editing, stylistic changes, or additional editing may incur additional fees or be declined.

RAW Files

Pictoniq does not provide RAW image files.

RAW files remain the exclusive property of Pictoniq.

Only professionally edited photographs are supplied to clients.

Photographer’s Portfolio Rights

Pictoniq is proud of the work we create.

With the client’s permission, photographs may be used for:

Our website
Portfolio
Blog articles
Social media
Printed promotional material
Photography competitions
Business marketing

If a client does not grant permission, Pictoniq will respect that decision and will not publicly display their images unless required by law.

Social Media Sharing

Clients are welcome to share their photographs online.

When sharing images, we appreciate being credited where practical, although this is not mandatory.

Image Alteration

To preserve the quality and artistic integrity of our work, we kindly request that clients do not:

Apply heavy filters
Change colour grading
Add AI-generated effects
Significantly alter editing
Remove watermarks from preview images

Minor cropping for social media or printing is perfectly acceptable.

Watermarked Images

Preview galleries or proof images may contain watermarks.

Watermarks must not be removed without purchasing or receiving the final edited photographs.

AI and Editing Technology

Pictoniq may use professional editing software and AI-assisted editing tools as part of our workflow.

These tools help improve efficiency while maintaining the artistic quality and consistency of our final images.

Image Retention

Pictoniq generally retains:

RAW image files for approximately 30 days after final delivery.
Online galleries for approximately 30 days unless extended by request.

Clients are responsible for downloading and safely backing up all delivered photographs.

After the retention period, images may be permanently removed from our systems.

Third-Party Use

No third party may reproduce, publish, distribute, or commercially use Pictoniq photographs without prior written permission from Pictoniq.

Copyright Infringement

Unauthorised commercial use, reproduction, distribution, or modification of Pictoniq photographs may constitute copyright infringement under Australian law.

Where appropriate, Pictoniq reserves the right to take reasonable action to protect its intellectual property.

If you are unsure whether a particular use is permitted, please contact us before using the photographs.
